Contest Rules
Massachusetts state law requires certain disclosures to protect all participating parties resulting in the following rules and regulations. Please see below.
- Eligibility No purchase necessary to enter or win. Prospective entrants must follow @capeyachts, @southwharf, @nautijanes on Instagram, like the contest announcement post, and tag at least one other Instagram User. Persons under 21 and employees and affiliates of South Wharf, Cape Yachts, or Nauti Jane’s Boat Rentals are not eligible to participate. The contest is not open to international participation. Entrants need not be present to win. Past winners of contests are not eligible to win.
- Qualification Period The qualification period begins when the Instagram contest content is posted on the @capeyachts Instagram account and ends the same day the following week at 11:59 pm.
- Entry Procedures Prospective entrants who meet the eligibility criteria must follow @capeyachts, @southwharf, and @nautijanes also tag three (3) Instagram users in the comments section of the contest announcement post. Multiple entries are permitted and encouraged.
- Duties of Participants; Limitation of Liability
By entering, participants agree to be bound by these rules and the decisions of Cape Yachts which shall be final. All federal, state, and local laws apply. Cape Yachts and its employees and representatives are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures, or difficulties; (iii) errors in transmission; (iv) any condition caused by events beyond the control of Cape Yachts that may cause the contest to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, or use of a prize, or from participation in the contest; or (vi) any printing or typographical errors in any materials associated with the contest. - Violation of Contest Rules
Cape Yachts reserves the right to disqualify any participant or winner who, in its sole suspicion, tampers with the entry process or acts in an unsportsmanlike or disruptive manner. - Selection of Winners; Chances of Winning Two (2) winners will be selected at random among all entries received for each contest period. Odds of winning depend on number of entries received.
- Description of Prizes Two (2) winners will receive two (2) tickets each to the Newport International Boat Show. The total value of the prize is $160 or $80 per winner.
- Notification of Winners; Substitution of Prizes Two (2) winners will be notified and announced via a public-facing congratulatory post on Instagram the day the winners are drawn. Cape Yachts will notify the winners one time in this public post. If any winner does not respond within seven days of notification, the prize will be forfeited. Prizes are not transferable. The contest is not subject to fair weather and the opening and closing of the Newport International Boat Show is not determined by Cape Yachts.
- Winners may not substitute prizes. Cape Yachts reserves the right to substitute a prize of equal or greater value in the event a prize is unavailable. Prizes are not redeemable for cash. All taxes on prize are winners’ responsibility. Limit one prize per household.
- Permissions Except where prohibited by law, entry constitutes permission to use winners’ names, hometowns, photography, and likenesses for online posting and/or any advertising and publicity without additional compensation. Failure to comply with the aforementioned conditions shall be grounds for forfeiture of a prize.
